In accordance with the requirements of Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as “GDPR Regulation”) applicable as of May 25, 2018, we are obliged to manage in secure conditions and only for the specified purposes the personal data you provide us with by using our website, our services or in connection with our activity, in accordance with the provisions of the GDPR Regulation.

C. Professional contacts of legal representatives, contact persons or employees of contractual partners, collected by ANTENA ACADEMY FOUNDATION in the performance of its activity. Specifically, the professional data processed are: name, surname, job title, telephone number, e-mail address.

D. Personal data contained in the Curriculum Vitae, submitted by candidates in consideration of the ANTENA ACADEMY FOUNDATION recruitment advertisements, as well as data of the Operator’s employees, including data relating to data on name and surname, home/residence address, date and place of birth, marital status, personal numeric code, citizenship, nationality, level of education and experience, employment status, e-mail address, telephone number and others, according to the requirements of the Labor Legislation.

E. Other information that you provide to us in correspondence with us by telephone, e-mail or otherwise, including, if applicable, questionnaires completed prior to filming or telephone interviews, and any other personal data that you choose to send us.

7.2. What happens if you do not give us your data.

Depending on the dates and purposes of collection, you may be able to enjoy this site or some of the services offered by the Operator without providing us with your personal data or your consent, or you may be able to enter only the minimum amount of information.     • when a Data Subject interacts with Foundation staff, , for example, by telephone, letters, fax, in-person meetings or email, for the management or administration of the relationship with the organization to which the Data Subject belongs;
    • when a Data Subject requests to be contacted by the Company, to be included in an email or other mailing lists, or when the Data Subject responds to the Foundation’s request for the provision of additional Personal Data;
    • when a Data Subject interacts with the Foundation through online platforms;
    • when the Foundation acts to prevent or investigate suspected fraud, illegal activities, omissions or misconduct relating to a Data Subject’s relationship with the Foundation or other natural/legal persons;
    • when a Data Subject sends his/her Personal Data or the Personal Data of a third person (e.g. information about his/her family members and/or employees, etc.) to the Company, for whatever reason;
    • in order to communicate with the Targeted Person through the channels that he/she has approved in advance in order to keep him/her informed about the activity of the Foundation or the Intact Group, by sending newsletters, announcements and other information about the services, products and technologies of the Foundation or any other company within the Intact Group, as well as about events and projects of the Foundation or any other company within the Intact Group;
    • for publicity purposes, including but not limited to advertisements in accordance with the preferences or interests expressed by the Data Subject for customer surveys, marketing campaigns, market analysis, sweepstakes, contests or other promotional activities or events;
    • in order to transmit news or information on events of interest in accordance with the choices made by the data subject
    • to comply with a request from any competent public authority or institution or when responding to requests for information from them;
    • when the Foundation performs fiscal, financial, regulatory, management, risk management (including exposure monitoring) and audit reporting;
    • for intra-group reporting within the INTACT MEDIA GROUP to which the Foundation belongs;
    • in order to comply with court decisions and to exercise and/or defend the Foundation’s rights;
    • in order to monitor and evaluate compliance with the Foundation’s policies and standards;
    • for any purpose related and/or ancillary to any of the above.

9. Legal grounds for data processing

a) Performance of a contract (Art. 6 para. (1) letter b of GDPR)

Personal data of employees, suppliers, collaborators, collaborators, trainees on the basis of contracts concluded with them, partners and the like, may be processed for the purpose of concluding, executing and finalizing a contract. For this purpose, processing is necessary:

  • for a contract which the Data Subject has concluded in his or her own name; or
  • Whereas the data subject took steps prior to the conclusion of a contract,

in both cases, including distance contracts concluded online or by telephone b) Consent (art.6 para. (1) lit. a of the GDPR) for the processing of special personal data, for profiling, for sending invitations to future courses.

c) Compliance with legal obligations (Art.6 para. (1) lit. c of the GDPR), if we have to comply with a legal obligation provided either by labor relations, accounting, auditing, copyright and other laws incident to the activity of the Operator.

e) Legitimate interest (art.6 para. (1) lit. f of GDPR) of ANTENA ACADEMY FOUNDATION in connection with the courses, namely:

  • registration of students ANTENA ACADEMY FOUNDATION;
  • protecting the vital interests of trainees and collaborators and providing appropriate protective measures;
  • providing direct access to participate in courses producing audiovisual materials to promote the FOUNDATION’s educational offer
  • keeping in the ANTENA ACADEMY FOUNDATION’s archive of all audio-video promotional materials and personal data contained therein for self-promotional purposes

In all cases where the processing will be carried out on the basis of our legitimate interest in providing services deriving from our specific field of activity, the Operator will analyze whether the right to freedom of expression, as provided for by the legislation in force, prevails over the right to image or privacy, otherwise it will cease processing that infringes the person concerned by these rights.

10. Categories of recipients to whom personal data collected may be transmitted

We do not disclose the personal data we collect about you except as described in this Policy or in separate notices provided in connection with certain activities. We may share your personal data in the following circumstances and to the following recipients:

  • ANTENA ACADEMY FOUNDATION staff (employees, collaborators);

  • To governmental or law enforcement authorities, if we are obliged to do so by law, such as for example: the National Agency for Fiscal Administration, the National Audiovisual Council, the Territorial Labor Inspectorate, the Health Insurance House and the Pension House, for the submission of various applications and forms, as well as other authorities for the fulfillment of other legal obligations;
  • We may also share your personal data with courts, regulators or lawyers or other persons if it is necessary for the establishment, exercise or defense of a legal or natural right, or for the purpose of a confidential alternative dispute resolution process;
  • In certain situations, data may also be shared with companies affiliated to the group to which ANTENA ACADEMY FOUNDATION belongs, namely INTACT MEDIA GROUP on a need-to-know basis, on a need-to-report basis, as well as other circumstances involving control and decisions at Group level.

Except as detailed above, we will never disclose, commercialize or lend any of your personal data to any third party without notifying you, or, where applicable, without obtaining your prior consent.

11. Transfer of personal data

The information we collect from you will be processed in the European Economic Area and may also go outside the European Economic Area, depending on the purpose of the processing. FUNDATIA ANTENA ACADEMY will apply appropriate safeguards to protect the confidentiality and security of your personal data during the transfer and to use it only in accordance with your relationship with FUNDATIA ANTENA ACADEMY and the practices described in this Privacy Policy. Any transfer of data will be carried out in compliance with the security requirements to which processing within the European Community is subject, of which compliance with EU standards on the processing of personal data is a component, thus ensuring that the desires set forth in the personal data protection legislation are met.

12. Your rights.

The GDPR Regulation gives data subjects certain rights, as follows:

a. The right to information and access to your data, which means that you can request a confirmation from the controller whether or not it processes personal data concerning you and if so, access to those data, as well as information on how the data are processed.

b. The right of data intervention, consisting in the possibility to obtain on request and free of charge the rectification, updating, blocking, restriction or erasure of data whose processing is not in compliance with the law, in particular inaccurate data, data that are no longer necessary for the purposes for which they were collected or when you withdraw your consent on the basis of which the processing takes place.

c. The right to rectification (correction) of your personal data processed by us if they are inaccurate or no longer correspond to reality.

d. The right to erasure or the “right to be forgotten” means the right to request erasure of data concerning you in certain circumstances, such as (i) your personal data is no longer necessary for the fulfillment of the purposes for which it was collected or processed; (ii) your data has been processed unlawfully; (iii) the processing of your data has taken place on the basis of your consent and your consent has been withdrawn.

e. The right to restriction of processing, entails the right to request the cessation of processing in certain circumstances, such as: (i) you contest the accuracy of the data for the period that would allow us to verify the accuracy of that data and (ii) your data has been processed unlawfully and you object to its erasure, requesting the restriction of its use.

f. The right to data portability, which means that when it is technically feasible, we will – upon your request – be able to provide you with your personal data or to transmit them directly to another controller. If access cannot be provided within a reasonable timeframe, we will provide you with a date by which the information will be transmitted.

g. The right to object refers to the right to object to the processing of personal data for legitimate and legitimate reasons related to the particular situation in which you find yourself. .   • the right to go to court to defend any rights guaranteed by law;
  • the right to be notified by the Controller of security breaches that have/could have an impact on the data of the data subjects.

In order to exercise the rights mentioned above, the data subjects shall send a written, signed and dated request by post to the controller’s headquarters or electronically to the Data Protection Officer’s e-mail address . The data subject will receive a reply as soon as possible, but no later than one month after receipt of the request.

In addition to the rights mentioned above, data subjects may lodge a complaint against the processing of their data directly to FUNDATIA ANTENA ACADEMY, stating their request, the reason for their dissatisfaction and/or the rights they consider to have been violated, or they may submit a complaint to the National Supervisory Authority for Personal Data Processing (www.dataprotection.ro) but not earlier than 30 days after a complaint has been submitted to the Controller.
